Justice System
As mentioned before, the Utolantis concept is a blueprint for a new civilization, close to an utopian ideal.
Yet we do understand that a completely ideal world is not realistic.
And for that reason, we have to accept that, despite the fact that we do all we can to prevent criminal activities, they will occur and we have to deal with that.
So, we will need a kind of Justice system. A justice system based upon the holistic worldview.
In a pure materialistic civilization, justice is based upon the law of the jungle.
Those in command, dictate by law, how the population has to behave, where these laws do not apply on themselves.
Dispute resolution is primarily focusing on punishment.
In a pure religious civilization, justice is based upon how the holy scriptures are interpret by the local priest, rabbi or imam.
Dispute resolution is primarily focusing on punishment.
In a pure holistic civilization, justice is based upon a true understanding of the criminal activity from a social and psychological perspective, the intention of the action and how it has negatively impacted the victims and the global/local community.
Dispute resolution is primarily focusing on prevention, healing and rehabilitation.
In our current civilizations, which are often a mixture of all 3 worldviews, we also see this mixture of justice systems.
For example, all around the world we see:
- The really big criminals either operate above the law or they get away with a fine that is far less than the profit they made with their criminal activity.
- There are numerous examples of legal inequality: rapists and murderers of some ethnic background are punished extremely light or not at all whereas healthcare professionals that stick to their Hippocratic oath or those who demonstrate for peace and democracy, are punished severely.
- Fines are disproportionate: the same $250 speeding ticket for person A means no food for the rest of the week where it is just 5 minutes of income loss for person B.
- Many more examples can be found once you start looking for them.
The Utolantis Justice system
The Utolantis justice system operates in multiple stages
Stage 1: prevention.
Prevention in the shape of:
- An anti-corruption mechanism
- Legal equality
- Social education
The best tool in the toolbox for any criminal is secrecy. Once we take the secrecy away, all criminal activity will occur in full daylight.
In Utolantis this principle is handled by Operation Transparency.
The more powerful your position is, the more risk there is for corruption and therefor your privacy rights will be less.
Utolantis does not support any forms of diplomatic – or legal immunity. Nobody will ever operate above the law.
All people will have free access to the complete education system.
This includes the development and training of social skills that will enable the people to apply the ethical golden rule : “ An it harm none, Do as thy wilt”
This will also improve interpersonal communication which will lead to less arguments and disputes, leading towards further escalation.
Stage 2: Mediation and evaluation:
Depending on the severity and impact of legal proceedings, a team with multiple stakeholders like the victim(s), offender(s) and community representatives (mediators) , come together and evaluate the entire topic like the circumstances, intentions and other closely related information.
Based upon this evaluation, the repercussion is defined where a golden rule that states that “all victims agree with this repercussion” , is respected.
Next to these repercussions towards the offender(s), healing the relationship with the victims and/or community is to be taken care of as well.
Stage 3: measuring and Learning
In contrast with a religious worldview where people are considered to be drawn towards evil by nature (as a result of the Original Sin), Utolantis (based upon a holistic worldview) considers all humans are good-hearted by nature.
From this perspective, we can also state that criminal activities are the result of an unjust environment/civilization.
For this reason, factual information is captured and used (together with figures on health) to objectively measure the quality of our (local) government.
